Council or Private Building Surveyor: Which Suits Your Wyndham Project?

In Wyndham you have a genuine choice. Wyndham City runs its own building permit service, and you can also appoint a private registered building surveyor. Both apply the same Building Act 1993, Building Regulations 2018 and National Construction Code; the difference is who you deal with and how the job is managed.

A private surveyor can suit you if you want:

  • one surveyor for projects across several councils, such as Wyndham, Melton and Hobsons Bay
  • direct contact with the person assessing your plans and booking inspections
  • early advice on estate approvals, easements and siting

For domestic work under a building contract, only the owner or the owner’s authorised agent can appoint a private surveyor, not the builder. The permit is then lodged with council within seven days of issue.

Building a New Home in Tarneit, Truganina or Manor Lakes?

Building in one of Wyndham’s newer estates adds an extra layer of rules. Developers commonly require their design panel’s approval before you apply for a building permit; the Savana estate’s guidelines say exactly that, and add that the MCP registered on title takes precedence over the guidelines.

In Wyndham’s growth areas, the Small Lot Housing Code can also apply to lots under 300 m² identified on the plan of subdivision. It sets siting standards, and a house that meets them doesn’t need a planning permit. We check the title, MCP and guidelines together so your new home building permit reflects all of them.

Can You Build Over the Easement on Your Lot?

Many lots have a drainage or sewer easement along a side or rear boundary, and Wyndham City is specific about what can go over the easements it owns. Council consent is needed, and council won’t allow habitable structures such as a granny flat, structures sharing the house’s roofline (like an extension), water tanks, hot water systems, or pools and spas.

Footings must also stay at least 600 mm from council stormwater infrastructure and 1 metre from stormwater inspection pits. For easements managed by Powercor or Greater Western Water, apply to that authority. Council’s easement page lists what to submit.

Building Surveyor Wyndham: How Your Permit Comes Together

Whether it’s a first home, a pergola or a warehouse mezzanine, the sequence is much the same. Getting each approval in the right order is what keeps a Wyndham project moving.

Property and Title Review

We check the title, plan of subdivision, easements and overlays, and request council property information where needed to confirm flood designation, permits from the past ten years and any outstanding notices.

Approvals in Order

Estate design approval, any planning permit, and council or service authority consents for siting variations, easements or flood-prone land are obtained before the building permit, so nothing stalls once work begins.

Permit and Lodgement

We issue the building permit once the plans, engineering and energy reports comply, then lodge it with Wyndham City within seven days. Council’s site rules, including 1.8 metre perimeter fencing, apply before work starts.

Inspections and Final

We inspect at each mandatory stage listed on the permit, from footings to frame to completion, then issue the occupancy permit or certificate of final inspection that your building permit requires.

Building Near the Werribee River, a Creek or the Coast?

Wyndham sits at the bottom of several large catchments. The Werribee River alone drains about 1,474 km², and Skeleton Creek, Lollypop Creek, Little River, Dry Creek and Davis Creek also cross the municipality. The flood management plan prepared for Wyndham City and Melbourne Water identifies three planning controls:

  • Land Subject to Inundation Overlay for land in a 1-in-100-year flood storage or fringe area
  • Special Building Overlay for urban land affected by overland flows
  • Urban Floodway Zone for waterways and major flood paths

On the coast, the plan identifies the Cheetham Wetlands, the Point Cook Marine Sanctuary and the mouth of the Werribee River as areas most affected by projected sea level rise. On flood-prone land, a planning permit and council’s report and consent may be needed before the building permit.

Warehouses and Fit-Outs in Laverton North and Truganina

Laverton North is predominantly industrial, and Truganina has become a major distribution hub, with large warehouses built for national retailers. Projects range from new warehouses and office components to mezzanines, canopies, extensions and change-of-use fit-outs.

Industrial buildings raise fire safety questions that houses don’t, such as essential safety measures, fire hydrants, sprinklers where required, and paths of travel to exits. We assess these early, work with your fire engineer when a performance solution is proposed, and issue the building and occupancy permits. See our warehouse building permits page for more.

Pools, Granny Flats and Backyard Projects

Typical backyard projects in Hoppers Crossing, Werribee and Point Cook include pools, pergolas, verandahs and small second dwellings. A small second dwelling of up to 60 m² often needs no planning permit where no flooding, environmental or other special controls apply, but it always needs a building permit, and it can’t sit over a council easement.

A pool or spa deeper than 300 mm needs a building permit for the pool and barrier, must be registered with Wyndham City within 30 days of completion, and its barrier must be inspected and certified every four years. See our pool and spa permits page.

Frequently Asked Questions

Common questions from Wyndham homeowners, builders and businesses.

Can I use a private building surveyor instead of Wyndham City?

Yes. Wyndham City offers its own building permit service, but you’re free to appoint a private registered building surveyor for any project. The private surveyor issues the permit, carries out the mandatory inspections and lodges documents with council, which still handles report and consent, easement consent, pool registration and property information.

Do I need estate approval before the building permit?

In many Wyndham estates, yes. Developers commonly require design approval before you apply for a building permit, but that approval confirms only that the design meets the estate guidelines, not the building code. We then check the plans against the title restrictions, MCP, Small Lot Housing Code if it applies, and Building Regulations.

Can I put a pool or granny flat over the easement?

Not over an easement owned by Wyndham City. Council doesn’t allow habitable structures such as granny flats, or pools and spas, over its easements, and footings must keep clear of stormwater pipes and pits. If Greater Western Water or Powercor manages the easement, you need to apply to that authority.

How do I find out if my Wyndham property is flood prone?

Check VicPlan for an LSIO, SBO or Urban Floodway Zone, and request council’s property information, which confirms whether the land is designated as liable to flooding. Melbourne Water and Wyndham City have also been updating flood mapping to inform future planning scheme changes, so we’ll flag anything that could affect your design.

Do you handle warehouse and industrial permits in Wyndham?

Yes. We issue building permits for new warehouses, extensions, mezzanines, offices and fit-outs in industrial areas such as Laverton North and Truganina, and carry out inspections through to the occupancy permit. For a change of use, we assess whether the existing building needs upgrading for the new use.
