Permits and Inspections Across Brimbank

Sunshine to Taylors Lakes

Brimbank covers about 123 square kilometres of Melbourne’s west and north-west, from the old village of Keilor on the Maribyrnong River to Sunshine, St Albans, Deer Park and the newer streets of Derrimut. If you need a building surveyor in Brimbank, JLN can take your project from first plans to final inspection.

We work with homeowners, builders, designers and business owners on sheds, extensions, new homes, warehouses and shop fit-outs. Because Brimbank mixes older housing, heritage pockets, creeks that flood and substantial industrial areas, we check the site-specific issues first, then deal with Brimbank City Council on lodgement and consents.

Choosing a Building Surveyor in Brimbank: Council or Private?

Brimbank City Council offers a building permit service, and private building surveyors can issue permits too. Whoever you choose becomes the relevant building surveyor for the job, and a project can only have one. The owner, or an agent with the owner’s written authority, makes the appointment; on a domestic building contract, the builder can’t.

A private surveyor gives you direct access to the person assessing your plans. As your surveyor, JLN will:

  • check your title, easements and overlays before the design is locked in
  • assess plans against the Building Act 1993, Building Regulations 2018 and NCC 2025, which Victoria adopted on 1 May 2026
  • issue the building permit and lodge it with council within 7 days
  • inspect each mandatory stage in person
  • issue the occupancy permit or certificate of final inspection

Post-War Homes, Rebuilds and Second Dwellings

Brimbank’s heritage strategy records post-war migrant housing in Sunshine West, Deer Park and St Albans, and Commonwealth munitions workers’ housing in Sunshine from the 1940s and 1950s. Homes from these eras are often candidates for an extension, a knock-down rebuild or a second dwelling.

A rebuild needs building permit approval for both the demolition and the new house, and an occupancy permit before you move in. A small second dwelling of up to 60 m² usually no longer needs a planning permit, but it always needs a building permit, can’t be subdivided and can’t connect to reticulated gas. Units usually need a planning permit first.

Heritage in Keilor Village and Sunshine

Brimbank has more heritage than many people expect. The Keilor Village precinct along the Old Calder Highway includes the 1859 court house and 1863 police station, and its mature trees and wide road reserves are part of its significance. Sunshine, which grew around H.V. McKay’s harvester works from 1906, has had a Heritage Overlay over the Grand Junction Estate and Matthew’s Hill precinct since March 2021.

Where a Heritage Overlay applies, demolition, extensions and external changes usually need a planning permit before we can issue the building permit. Council runs a heritage advisory service, and we flag heritage controls when we quote.

Getting a Brimbank Building Permit, Step by Step

Most Brimbank projects follow the same four steps. Council consents for easements, drainage and flooding come early in the process, so we identify them at the start, well before your builder starts booking trades.

Site and title check

We check your title for easements and covenants, and VicPlan for heritage, flood, airport noise and bushfire controls. A property information request shows recent permits and whether the land is designated as flood-prone.

Council consents first

Building over or in an easement needs council consent before the building permit application. Siting variations need report and consent, and building on flood-prone land needs consent from council’s roads and drainage team.

Permit and lodgement

Once the design complies, we issue the building permit, listing the mandatory inspection stages. We lodge it with Brimbank City Council within 7 days, and your builder can then get started on site.

Inspect and certify

Your builder notifies us at each stage, typically footings, any specified reinforced concrete, frame and final. We inspect in person and finish with an occupancy permit for a new building or a certificate of final inspection for alterations.

Is Your Brimbank Property Flood-Prone?

VICSES describes the Maribyrnong River as the main waterway through the municipality and Kororoit Creek as the second, while Taylors, Steele and Jones Creeks can rise and fall quickly after heavy rain. In Keilor, land north of the Calder Freeway sits on the river’s flood plain, and 10 Keilor properties were placed under an interim Land Subject to Inundation Overlay in response to the October 2022 flood.

For a building permit, that can mean:

  • a planning permit where a Special Building Overlay or Land Subject to Inundation Overlay applies
  • council consent to build on land liable to flooding, with floor levels designed around the flood level
  • changing overlays: Melbourne Water’s draft stormwater flood maps closed for comment on 9 September 2026, with final maps due in early 2027

Warehouses, Factories and Commercial Fit-Outs

Brimbank has substantial industrial and commercial areas, and we issue permits for warehouses, extensions, mezzanines, office fit-outs and changes of use. Commercial work raises different questions from a house: fire resistance, exits and travel distances, essential safety measures, accessibility and energy efficiency.

We assess the design against the current NCC, issue the building permit, inspect the work and, where required, issue the occupancy permit before the space is used. Converting a warehouse into a gym or a shop into a cafe? Talk to us before you sign the lease so you know what upgrades may be needed.

Airport Noise, Bushfire and Waterway Controls

Some less obvious controls also reach into Brimbank. The Melbourne Airport Environs Overlay applies to parts of the municipality; in its high-noise schedule it limits a lot to one dwelling, and new buildings that need a planning permit must meet the aircraft noise standard AS 2021-2015.

Brimbank’s bushfire prone area map was updated in February 2026 and is reviewed twice a year. New homes in a bushfire prone area must be built to at least BAL 12.5. Since 20 January 2026, Significant Landscape Overlays have also applied along waterways including the Maribyrnong River and Kororoit Creek, affecting earthworks, vegetation removal and fencing.

Frequently Asked Questions

Common questions from Brimbank homeowners, builders and businesses.

Does Brimbank City Council have to approve a private building permit?

No. A private building surveyor issues the permit and lodges it with council within 7 days; council doesn’t re-assess the design. Some council approvals may still be needed before the permit can be issued, such as consent to build over an easement, report and consent for a siting variation, flood consent or a planning permit.

Can I build a carport or garage over the easement at the back of my block?

Possibly, but you need Brimbank City Council’s consent before you apply for the building permit. Council considers the drainage assets in the easement and the type of structure. As a general guide, a lightweight, removable structure such as an open carport is more likely to be accepted than a habitable room or a pool.

Do I need a building permit for a garden shed in Brimbank?

Often not. A freestanding shed is generally exempt if its floor area is 10 m² or less, it is no more than 3 m high (2.4 m within 1 m of a boundary), it isn’t masonry and it isn’t in front of the house. Keep it off easements unless council consents. Bigger sheds need a shed building permit.

How do I check if my Keilor or Sunshine property is flood-affected?

Start with two checks: the flood overlays shown for your address in VicPlan, and a regulation 51(2) certificate from Brimbank City Council confirming whether the land is designated liable to flooding. Then keep an eye on Melbourne Water’s new mapping, due in early 2027, because overlays in Keilor, Sunshine and elsewhere may shift.

When does a new pool or spa have to be registered in Brimbank?

Within 30 days of the certificate of final inspection or occupancy permit, using council’s registration form. After that, the barrier must be inspected and a certificate of barrier compliance lodged every 4 years. We issue pool and spa building permits and can inspect existing barriers.
