Swimming Pool & Spa Permits 2

A building permit is required for all swimming pools, spas and associated safety barriers prior to the commencement of any construction or installation works. This applies to in-ground pools, above-ground pools, and inflatable pools with a depth greater than 300mm.

Stay Compliant with Victorian Pool Regulations

Since the introduction of updated requirements under the National Construction Code and associated Victorian regulations, the design, construction and maintenance of swimming pools have become more stringent.

These regulations place significant emphasis on:

  • The installation and ongoing compliance of safety barriers 
  • Improved protection for children and vulnerable users 
  • Consistent standards across both new and existing pools 

Pool and spa owners are legally required to maintain compliant safety barriers at all times in accordance with AS 1926.1 – Swimming Pool Safety Barriers.

JLN Building Consultants provides detailed safety barrier assessments to ensure all fences, gates, doors and windows associated with pool areas comply with current Australian Standards.

What is Required for Compliance

To meet legislative requirements in Victoria, all swimming pools and spas must:

  • Be issued with a valid Building Permit prior to construction 
  • Be protected by a compliant safety barrier 
  • Include a compliant water recirculation system in accordance with AS 1926.3 

Failure to comply with these requirements may result in significant penalties. More importantly, non-compliance can place lives at risk.

Pool & Spa Permit Requirements

A Building Permit is required for:

  • All swimming pools and spas exceeding 300mm in depth 
  • Both in-ground and above-ground installations 
  • The construction, installation or alteration of any safety barrier 
  • Modifications to windows, doors or gates that provide access to the pool area 

Approval must be obtained before any works commence.
